A Viable Product vs. The Legal System

In the United States, the most litigious country in the world, a products liability action may be brought, under state law, for express or implied breach of warranty, misrepresentation and negligence. Under the theory of strict liability, a lawsuit may be initiated on the grounds of manufacturing and design defects as well as poor and inadequate warning instructions. The best defensive strategy for a company to avoid becoming involved in any of the above is to manufacture the safest product possible within parameters of economic feasibility. If said manufacturer can vouch for safety factors in the design, production, testing, inspection and evaluation of its product as well as attentiveness to consumer complaints, it will be more likely to avoid litigation or at least be able to prevail in the courtroom.

Persons With Depressive Symptoms And The Treatments They Receive: A Comparison Of Primary Care Physicians And Psychiatrists

Objective: To determine if demographic differences exist in patients with depressive symptoms as the principal reason for visits to primary care physicians (PCP) versus psychiatrists. To estimate the likelihood of these patients receiving a range of mental health services from each provider group. Methods: Review and analysis of all outpatient visits made by patients with depressive symptoms using the National Ambulatory Medical Care Surveys (NAMCS) conducted in 1995 and 1996. Results: A significantly greater proportion of visits by persons with depressive symptoms as the principal reason for visit were made to psychiatrists than to primary care physicians (T = -3.56, P = .000).

Objective: The authors compared data from psychiatrists and psychologists in California to determine whether long-standing differences in clinical practice remain after the introduction of managed care and other changes in mental service delivery. Methods: Responses from practicing clinicians in California who participated in the 1998 National Survey of Psychiatric Practice and the 2000 California Survey of Psychological Practice were compared on items related to patient caseload, practice profile, and insurance or reimbursement arrangements.

Forensic Sound Analyses of Cellular Telephone Recordings

Recordings involving cellular telephones or personal digital assistants (“PDAs”) are increasingly the source evidence in audio forensic examinations, compared to recordings originating with other devices such as hand-held digital recorders. On modern PDA cellular telephones recordings can be made either directly to the telephone or transmitted as voice mail messages. The current investigation focuses on differences in the two types of recordings in terms of dynamic range and linearity of levels. Such information can be important for characterizing the distance of sound sources relative to the microphone and are important for understanding transformation of recorded speech and non-speech sounds.
