As an urban planner by background, there are certain clichés I have grown to loath. Among my least favorite is the phrase 'paradigm shift.' This is because few things in the transportation field ever comprise a paradigm shift. Among the true exceptions were the 45-foot-long coach, the proliferation of double-deckers, Megabus pricing, and the advances in super-clean diesel engines. Autonomous coaches seem decades away (even while exploding on the scene in Europe). Otherwise, nothing else close to a paradigm shift in this traditional industry comes to mind.

Proving the Cause-Effect Linkage

Contractor’s claim submittals and expert reports are often deficient in proving causation, i.e., the cause-effect linkage. These claims generally outline the owner-caused impacts and separately calculate quantum; however, the two are often not linked in any meaningful way. Most claims are settled prior to a decision by a panel, court, or board, and therefore these deficiencies are not made apparent. Yet, a well-prepared claim document which includes a persuasive and accurate causeeffect analysis can greatly improve the contractor’s chances of a successful recovery, either through negotiations or in arbitration/litigation. This analysis is difficult and often costly to prepare, and is therefore not performed in many disputes, which may be the reason why the claims fail.

Do You need an Insurance Expert?

It's a daunting decision, whether or not you need to pay for an insurance expert when you have an insurance claim. Typically, you would just contact your broker to handle things. And while this might be the right and necessary decision, your broker represents the insurance company. That means they work for them, not you. If you're in a fender bender, then calling your broker or agent is most likely the best first step. The truth is that you may be able to handle the matter yourself. Once you make the call and file the claim, the insurance company's adjuster will come out, take note of the damage, assign a value and pay you. If your body shop disagrees with the claims adjuster, they can call the adjuster, file a subsequent claim, and handle the matter for you.

At a conference entitled Patents in Telecoms & the Internet of Things, at George Washington University in the District of Columbia last week, I was perturbed to hear a speaker mischaracterizing the communications standards as platforms of preexisting technologies upon which IoT innovation will occur. Major research and development investments are being made in communications technologies and standards to satisfy the anticipated demands of 5G and IoT. In fact, these investments, with significant innovations resulting already, are largely a leap of faith in advance of hoped-for IoT applications development and proof of demand for these.
