Current Trends: The Unintended Results of the Absolute Exclusion

By: Frederick Fisher, JD, CCP

Two mutually exclusive goals are beginning to result in apparently unintended results within the executive and professional liability markets. The quest for underwriting profits and the desire to develop clear (to whatever extent possible) coverage language have rapidly changed the coverage landscape within these two lines of coverage.

Buses and Bikes - Mass, Visibility and Unfair Fights

By: Ned Einstein

In those rare instances where the safety of transportation modes can be compared statistically, bus riders fare several decimal points better than bicycle riders. The risks associated with motorcycles are "off the charts." The Figure below illustrates these comparisons for "home-to-school" trips - trips that comprise 15 percent of all transit trips and 96 percent of all schoolbus trips.

The Need for First Responders to be Trained and Equipped to Perform Domestic Animal Rescues

By: Gerald Dworkin

Based on our research of ice rescue incidents and fatalities during the years 2006 & 2007, approximately 85% of the incidents were initiated as a result of humans venturing out onto the ice to rescue a domestic animal. The purpose of this article is three-fold. First, we need to educate the public about the need to control their pets and to prevent them from going out onto the ice because no ice should ever be considered as being "safe ice". Second, we need to also educate the public to call 911, rather than to make an attempt to rescue their pets that have fallen through the ice. And, third, First Responder agencies and their personnel need to be trained and equipped to properly, effectively, and safely respond to domestic animal rescues on and through the ice.

Crowns & Veneers: Dental Mistakes Cause Physical Pain, Speech Problems, and Concerns for Appearance

By: Dr. Gregg Helvey

Patient presented to my office on 9/17/12 with the chief complaint of a recently placed crown on tooth #10 that had chipped. She said that the treating dentist, Dr. R, said that it could not be fixed and she would need to replace the veneer at her cost. Not satisfied with that response, she consulted another local dentist who gave her the same information. Still frustrated with her situation, she searched the internet and found an article that I published on repairing chipped porcelain.

Organic Fertilizers: Of Trends, Science and Chickens

By: Joe Samnik

Trends are fascinating and exhilarating phenomena. They allow pundits the opportunity to pontificate upon things which may never happen but are nonetheless given great credence due to the expertise of the pontificator. Trends tend to focus on the minutia of a far greater whole, and more likely than not are short-lived. Trends are fun to watch and a delight to participate in. Trends define goals and give us hope to better ourselves and our communities. We want to become a trendsetter due to its elitism and social stature. We want to follow trendsetters because there's safety in numbers. But lurking in the hallowed halls of this intermittent euphoria lays danger. Nothing can disappear quicker than Elvis Presley sideburns then to follow a trend and ignore the science behind it.

Compromising Safety to Reduce Liability Exposure

By: Ned Einstein

Every responsible society has mechanisms to hold its citizens, and their organizations, accountable for their actions. With respect to safety, our society effects this goal through the enactment and enforcement of statutes and regulations, and through the process of civil litigation. As with most rules and most societies, many of our transportation organizations have discovered loopholes. Employing these loopholes, they have effectively reduced their liability exposure at the cost of compromising safety.
